Event Services Agreement
1. Booking and PaymentSubmitting an inquiry, questionnaire, or quote request does not reserve an event date.
Full payment is typically required in advance. In some cases, a partial booking retainer may be accepted to reserve the event date, with the remaining balance due by the deadline shown in the Booking Summary. The booking is confirmed only after: The Client has accepted this Agreement; and the required booking payment has been received. Changes to the services, location, schedule, guest count, number of artists, or event requirements may affect the final price and must be approved in writing.2. Services ProvidedThe number of participants who can be served depends on the selected services, design complexity, participant cooperation, event conditions, and available time. The Provider cannot guarantee that every guest will receive a service. The Client is responsible for providing an accurate estimate of attendance and reserving enough time and artists for the expected number of participants.3. Client and Event ResponsibilitiesThe Client is responsible for:• Providing an adult event-day contact
• Supervising children and vulnerable guests
• Obtaining parent or guardian permission before services are provided to a minor
• Providing safe and reasonable access to the service area
• Informing the provider about parking, stairs, loading restrictions, security procedures, and venue rules
• Preventing guests from handling products, tools, supplies, or equipment without permission
• Keeping the artist’s designated workspace reasonably clear and controlledParents, guardians, and caregivers remain responsible for children at all times.4. Outdoor Events and Weather ProtectionFor outdoor events, the Client must provide a stable, adequately covered workspace that protects the artists, participants, products, tools, and equipment from direct sunlight, rain, wind, airborne debris, and extreme temperatures. Suitable protection may include a securely installed canopy or an appropriate indoor backup location. The covered area must be large enough for the artist, worktable, supplies, seating, and participant receiving the service.Sam Paints Magic does not provide a canopy, umbrella, or other weather shelter. If suitable shelter is not available when the Provider arrives, the Provider may delay, relocate, modify, pause, or decline to provide services. Time lost because the required workspace was not provided will not extend the scheduled end time. If the Provider cannot perform because the Client or venue failed to provide the agreed workspace or weather protection, the situation will be treated as a Client cancellation. The Provider may also pause or discontinue services when changing conditions create a safety concern, including heavy rain, strong wind, excessive heat, lightning, smoke, fumes, or flying debris. If unsafe or unsuitable weather is reasonably anticipated and the Client does not contact the Provider before the event to discuss relocation or rescheduling, and the required working conditions are unavailable upon arrival, the event may be treated as a Client cancellation under this Agreement.5. Health, Hygiene, and Service RefusalProducts intended for the selected services will be used according to their labels, manufacturer instructions, and applicable requirements. The Client, participant, parent, or caregiver must disclose any known allergies, sensitivities, skin conditions, or previous reactions before products are applied. The Provider may decline or discontinue service when a participant:Has broken, irritated, infected, or visibly compromised skin
Shows signs of a contagious illness
Appears unwilling, frightened, or distressed
Behaves aggressively, abusively, or unsafely
Cannot safely receive the requested service
Requests hateful, discriminatory, threatening, or inappropriate imageryChildren will not be pressured or physically restrained to receive a service.6. Service Times and DelaysServices will begin and end at the times shown in the Booking Summary. The Provider may close the service line before the scheduled end time when necessary to complete the remaining participants by the agreed ending time.Delays caused by the Client, venue, event schedule, parking, restricted access, guests, or an unavailable workspace do not automatically extend the booked service period.Additional time may be provided only when the artist is available. Any additional time and payment must be approved by both parties. If an artist arrives late, the Provider will make reasonable efforts to extend the service. If an extension is not possible, the Client will receive an appropriate adjustment for the service time that was not provided.7. Additional Artists and SubstitutionsFor larger events, Sam Paints Magic may coordinate additional artists or performers. The number of service providers, scheduled hours, and assigned services will be listed in the Booking Summary.8. Travel, Parking, and AccessTravel charges, when applicable, will be included in the quote or Booking Summary. The Client is responsible for parking charges, tolls, venue access charges, or similar expenses when disclosed before the event or reasonably incurred because of venue requirements. The Client must provide accurate parking, unloading, entrance, and setup instructions. Unusual access conditions may require additional time or charges.9. Cancellations and ReschedulingAll payments are subject to the following cancellation policy unless different terms appear in the Booking Summary:Seven or more calendar days before the event: The Client will receive a refund minus the stated booking retainer and any approved, nonrecoverable event expenses. Two to six calendar days before the event: The Client will receive a refund of 50% of the total booking price.Less than 48 hours before the event: No refund will be issued.
Failure to provide access, the required workspace, or necessary event information: This may be treated as a cancellation occurring on the event date.A rescheduling request is subject to availability and must be approved in writing. Payments do not automatically transfer to another date. When a rescheduling request is approved, the Provider will confirm in writing whether previous payments will transfer and whether any price adjustment applies.California places special restrictions on predetermined cancellation damages in consumer service contracts. The final percentages should represent a reasonable estimate of losses associated with reserving the date, administrative work, declined bookings, and unrecoverable expenses, not a punishment for canceling.10. Cancellation by the ProviderIf the assigned artist cannot perform because of illness, emergency, or another unavoidable circumstance, the Provider may offer:A qualified substitute
A mutually agreed rescheduled date
A refund for services not providedIf no suitable replacement or rescheduled date can be arranged, payments for services not performed will be refunded.11. Unsafe or Inappropriate ConditionsThe Provider may pause, modify, or end services when conditions create a reasonable concern for the safety, health, dignity, or professional treatment of an artist, participant, or guest.Examples include threatening behavior, harassment, uncontrolled crowds, dangerous structures, illegal activity, severe intoxication, smoke, fumes, hazardous weather, or repeated interference with equipment.Ending services because of unsafe conditions caused by the Client, venue, or guests does not automatically entitle the Client to a refund. This Agreement does not attempt to excuse fraud, intentional injury, illegal conduct, or any responsibility that cannot lawfully be waived. California Civil Code section 1668 restricts contracts that attempt to eliminate responsibility for fraud, willful injury, or violations of law.12. Clothing, Property, and EquipmentCertain face paints, cosmetics, henna products, glitter, craft materials, and art supplies may stain clothing, furniture, flooring, or nearby surfaces. The Provider will exercise reasonable care, but the Client is responsible for protecting the service area and informing guests that staining may occur. The Client may be responsible for reasonable repair or replacement costs when equipment or supplies are intentionally damaged or damaged through the actions of the Client, venue, or guests.13. Photography and Promotional UsePhotography permission will be requested separately.Consent to photography is optional and is not required to receive services. Recognizable images of minors will not be intentionally used for promotional purposes without permission from a parent or legal guardian.15. Entire Agreement and ChangesThe Booking Summary, this Event Services Agreement, and any attached service-specific addendum make up the complete agreement between the Provider and Client. If the Booking Summary conflicts with general information displayed elsewhere on the website, the Booking Summary and signed Agreement will control.Any material change to the event date, services, price, payment schedule, or responsibilities must be approved in writing by both parties. Email or another documented electronic message may be used for written approval. If one provision of this Agreement is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. This Agreement is governed by California law.16.
